Baltimore Police Chase Crash Fatal Injuries

Posted on

A high-speed pursuit that ended in a head-on collision has left two people dead and several more injured. The crash happened on Friday, December 11, 2015 in the southbound lane of I-95 near White Marsh Boulevard. One of the victims, a 35 year-old man from Baltimore, was a passenger in the vehicle trying to elude police. Also killed in the wreck was the innocent person struck head-on by the fleeing vehicle; a 52 year-old woman from Washington. Police have charged the driver of the car who caused the crash with fleeing and eluding a car accident involving death.

Accidents like this one happen far too often in Maryland. In 2010, a Baltimore City police officer was suspended after his cruiser collided with a motorcycle he was chasing, killing the rider. The family of the victim later filed a wrongful death lawsuit against the officer. Just last year, there were at least two incidents of innocent people being struck and killed by suspects trying to elude police. Research shows that on average, more than one person is killed every day in a motor vehicle accident resulting from a police chase. One third of those who die are innocent bystanders.

Car accidents that are the result of police pursuits can be extremely serious. They are often caused by suspects’ dangerous driving behaviors such as speeding, high-speed lane changes, and running red lights. Many times, it is not only the suspect who is driving erratically, but also the police who are chasing the vehicle. When a crash happens, the resulting property damage and physical injuries are often severe. Determining who can be held liable in these tragic crashes is tricky, as each case is unique.

In general, police officers are immune from lawsuits arising from car accidents that occurred while the officer was pursuing a violator or suspected violator of the law. That being said, the exact definition of the Maryland law is decidedly narrow; and as a result, exceptions have been made. It is important for injured victims of police chase accidents to consult an experienced Maryland car accident lawyer who is familiar handling these types of car accident claims.
