Maryland DUI Statutes

In Maryland, it is illegal for anybody to drive with a blood alcohol content (BAC) of 0.08 percent or higher. Specific laws also apply to drivers under the legal drinking age of 21 and commercial vehicle drivers. People under the age of 21 who drive with a BAC of 0.02 percent or higher are considered impaired and can be charged with drunk driving. Commercial vehicle drivers can be charged with drunk driving in Maryland if their BAC is 0.04 percent or higher.

DUI Criminal Charges Versus Civil Lawsuit

A drunk driver who causes an accident in Maryland will be prosecuted in Maryland criminal court. The prosecuting attorney must prove beyond a reasonable doubt that the driver was driving while impaired by drugs or alcohol in order to obtain a conviction in a criminal case. Penalties for those convicted of drunk driving could include incarceration, probation, fines and restitution. Unfortunately, the amount of restitution ordered is often insufficient to cover the extensive damages caused by a drunk driver.

Our Maryland car accident lawyers will negotiate with the other driver’s auto insurance company to recover full and fair compensation for your injuries or loss. Criminal records can be used to determine fault and prove that the other driver was impaired by alcohol or drugs and that he or she is liable for causing the car accident.  In some cases, an additional party may also be legally responsible fro your injuries or loss, and our knowledgeable attorneys can assist you in filing a third party claim.
